Please read these Terms of Service carefully before using Jomi. By creating an account or using the Service, you agree to be bound by these terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Jomi application, website, and related services (collectively, the "Service") operated by Ivan Chabanenko, a sole trader (Einzelunternehmen) established at Lutherstraße 12, 39112 Magdeburg, Germany, trading as chbnk ("Jomi," "we," "us," or "our"). Full provider details are set out in our Impressum. By accessing or using our Service, you confirm that you are at least 13 years of age (or 16 in the European Economic Area), that you have read and understood these Terms, and that you agree to be bound by them.
2. Description of Service
Jomi provides an AI-powered nutrition tracking application that allows users to log food intake via natural language chat, camera food recognition, and manual entry. The Service provides estimated calorie and macronutrient information based on AI analysis. Jomi is not a medical service and does not provide medical advice, diagnosis, or treatment. All nutritional information provided is for informational purposes only. Always consult a qualified healthcare professional before making significant changes to your diet.
3. Account Registration
To use most features of the Service, you must register for an account. You agree to:
Provide accurate and complete information during registration
Keep your account credentials secure and not share them with others
Promptly notify us of any unauthorized use of your account at support-jomi@chbnk.one
Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that are fraudulently created.
4. Subscription Plans and Billing
4.1 Free Plan
The Jomi Free plan is available at no cost with limited features. We reserve the right to modify the features included in the Free plan at any time with 30 days notice to existing users.
4.2 Paid Subscriptions
Paid subscription plans (Pro, Family) are billed on a monthly or annual basis. Annual plans are billed in full at the start of the subscription period. Prices are subject to change with 30 days advance notice. All charges are in USD unless otherwise specified.
4.3 Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then. We offer a full refund within 14 days of your initial subscription purchase. Annual plan refunds after 14 days are prorated for the unused months. Subscriptions purchased through the Apple App Store or Google Play are subject to those platforms' refund policies.
4.4 Free Trial
We may offer free trials for paid plans. Your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before the trial expires. You will be notified 3 days before the trial ends.
5. Acceptable Use
You agree not to use the Service to:
Violate any applicable law or regulation
Attempt to reverse-engineer, decompile, or extract source code from the Service
Use automated tools to scrape, crawl, or extract data from the Service
Attempt to access other users' accounts or data
Upload content that is illegal, harmful, or violates the rights of third parties
Interfere with or disrupt the integrity or performance of the Service
6. AI Accuracy Disclaimer
The calorie and nutritional information provided by Jomi's AI is an estimate based on available data and AI analysis. Jomi does not guarantee the accuracy of any nutritional information. Results may vary based on specific preparation methods, portion sizes, ingredient variations, and regional food differences. Do not rely solely on Jomi for medical nutrition therapy, eating disorder treatment, or any clinical dietary intervention. Always consult a registered dietitian or physician for medical dietary guidance.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Ivan Chabanenko (trading as chbnk) and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
You retain ownership of your personal data (food logs, goals, etc.). By using the Service, you grant Jomi a limited license to process and store your data solely for the purpose of providing the Service to you.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the operator of Jomi and any persons acting on his behalf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you have paid to Jomi in the twelve months preceding the claim, or $100, whichever is greater.
9. Termination
We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease.
You may delete your account at any time from the app settings. Upon account deletion, your data will be removed per our Privacy Policy.
10. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms will first be attempted to be resolved through good-faith negotiation. If not resolved within 60 days, disputes shall be resolved by binding arbitration under the American Arbitration Association rules, except that you may bring claims in small claims court if they qualify.
Users in the European Union may also contact their local data protection authority regarding data-related disputes.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email and/or a prominent in-app notice at least 30 days before changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
